EET Elections & Business Sales: The CGT Consequences of Fixing a Company as a Beneficiary - November 2026
Online Webinar – 1 Hour of CPD with Peter Johnson
12:00 PM, Tuesday, 24 November 2026 (AEDT)
Many of your clients will be asking about the EET election this year. It’s an attractive option: part of the income goes to a company at 25%, and the trust stays exactly as it is.
The question you’ll need to answer is what happens when that client sells the business. One of the biggest advantages of trading through a trust has always been how the capital gain on goodwill can be distributed. With an EET election in place, part of that gain has to go to the company, unless the election is revoked and 47% is paid in the year of revocation.
In this one-hour webinar, I’ll model a sale through a trust with an EET election, with part of the gain going to mum, part to dad and part to the company. We’ll compare the outcomes and work out which of the three paths is right for your client.
In this webinar, we will cover:
- Keeping the company as a fixed beneficiary through to the sale, and when that still works.
- Revoking the election the year before the sale, and how to keep the 47% exposure small.
- Restructuring instead, and when neither of the first two options fits.
- Which concessions make it through the company to the shareholders, and which don’t.
- Using the retirement exemption to pay an exempt amount through an interposed company.
- Why declining the 50% active asset reduction can produce a better result for the family.
- A simple framework using profit, sale value and 15-year exemption eligibility to decide early.
You’ll come away able to give clear advice on the EET election before your clients commit to it.
