There are high numbers of trusts where the deeds are not

effectively executed, requiring rectification work

25 years ago, accountants would send trusts to local solicitors to procure the necessary legal documentation. Three to six weeks later the client would return, fully executed and stamped deed in hand. The accountant then attended to the necessary tax work for the trust.


Fast forward 25 years - Accountants go online to a document provider, procure a trust deed (may or may not be reviewed by a lawyer), and then get the clients to execute the deeds and attend to any necessary stamping. In most cases, there is no lawyer involved in the process at all.


Technology companies have found out they can make a lot of money by automating legal documents. All they need to do is put a big disclaimer on them so that all responsibility passes to the accountant.


You can never be certain of the consequences of incorrectly executing a trust deed but it is certainly very risky and from experience, the document providers don't get it right.


In this training, we will look at the laws regarding execution of trust deeds for both individuals and corporations, the type of things you need to be careful of when ordering trust documents, the things you need to consider when transferring interests in trusts and companies, and then what to do when you discover that a large portion of your existing trusts have technical deficiencies.
