Exclusive Online Webinar for Practising Accountants

Getting Your Trust Documents Right

What has become a concern recently is the high number of trusts where the deeds are not effectively executed, requiring rectification work. Deeds come from a wide range of sources, many different law firms and a large number of accounting firms as well.
Nowadays, documents are produced online. While they can streamline the process, they might not be correctly executed.
This webinar is designed to better equip yourself on executing trust deeds and having the ability to conduct a review of your current documentation knowing the common errors to look for.
Although this is not a webinar about electronic execution, there have been substantial changes to the electronic signing of documents during the period affected by Covid-19.
Some of these changes are permanent and some are temporary. We will briefly cover where we are heading in relation to the electronic signing of deeds and other documents.

This training will run as one online webinar session beginning on:
Thursday, 12PM, 16th December 2021 (AEDT)

There are high numbers of trusts where the deeds are not effectively executed, requiring rectification work

25 years ago, accountants would send trusts to local solicitors to procure the necessary legal documentation. Three to six weeks later the client would return, fully executed and stamped deed in hand. The accountant then attended to the necessary tax work for the trust.
Fast forward 25 years - Accountants go online to a document provider, procure a trust deed (may or may not be reviewed by a lawyer), and then get the clients to execute the deeds and attend to any necessary stamping. In most cases, there is no lawyer involved in the process at all.
Technology companies have found out they can make a lot of money by automating legal documents. All they need to do is put a big disclaimer on them so that all responsibility passes to the accountant.
You can never be certain of the consequences of incorrectly executing a trust deed but it is certainly very risky and from experience, the document providers don't get it right.
In this training, we will look at the laws regarding the execution of trust deeds for both individuals and corporations, the type of things you need to be careful of when ordering trust documents, the things you need to consider when transferring interests in trusts and companies, and then what to do when you discover that a large portion of your existing trusts has technical deficiencies.

What Peter's Clients Have Said About Advisers Digest

What Peter's Clients Have Said About Advisers Digest

"In late February 2018, Peter and I discussed one of my clients and a possible Estate Planning Exercise for them.

I presented a proposal to the client recently and today they have agreed to the proposal. We're going to look at their super as well (Mum and Dad are close to the $1.6m caps) and combined with the Estate Planning exercise, they're just signed off on a $26K + GST contract.

The past 18 months have been a lot of "head down tail up" in this transition to my new business life. It is only with Peter's input that Tuesday afternoon that it dawned on me what we should be doing for this client. I wanted to thank them sincerely for being in the sounding board that afternoon and raising with me this idea.

I appreciate it immensely. "

"I could'nt speak more highly of the experience I have had with Peter to date...

  • Excellent technical support as access to the owner of the business
  • Fantastic turnaround time
  • Managed to get me an SOA for a new set-up including LRBA in anticipation of an Auction within a couple of days
  • Great process of initial SOA's for existing SMSF's and then ROA thereafter
  • Training provided is very practical

I am very happy to recommend this service. "
