The first question is regarding a question raised to me regarding under what circumstances are people outside of NSW subject to the NSW Succession Act when they die? It’s really important because the
NSW Succession Act has serious implications around binding death benefit nominations, so we’ll talk about when the NSW Succession Act could apply to estates outside of New South Wales.
[What Are The Voting Rules For SMSF Trustees?]
The second question is to do with an SMSF dispute where the accountant has asked what the rules are in the trust deed about voting. Where the trustees are in dispute about the valuation on an asset within the fund, is it the trust deed or is it the constitution of the company that details what you need to do.
We’ll also look into what the common law actually says around voting for trustees as well.
